Back to Top Because most clients cannot afford to pay hourly fees and costs of litigation, most attorneys accept contingency fee. That is, the attorney gets paid only if there is a recovery, with the fee being some percentage of what you are awarded. With a contingency arrangement, you still may have to reimburse your attorney for out-of-pocket expenses. If you choose not to hire an attorney to represent you, you will have to bear various costs directly. These may include filing fees, deposition and transcripts costs, travel, experts and others, as well as your time and effort. Our clients usually prefer that we work on a contingency fee and that we assume responsibility for all out-of-pocket costs during the litigation. These costs may run into the tens or even hundreds of thousands of dollars, depending on the case.
